Terms of Service

These terms ("Terms") govern your use of PropShot ("Service"). By creating an account or using PropShot you agree to these Terms. If you do not agree, do not use the Service.

Who can use PropShot

PropShot is built for licensed real-estate professionals. You must be at least 18. You are responsible for all activity that happens under your account.

What PropShot does

PropShot is a photo-editing tool for real-estate listing photos. You upload photos, apply tools (enhancements, perspective correction, virtual staging, object removal, twilight conversion, sky replacement), and download the edited results.

Acceptable use — real-estate photos only

PropShot is intended only for editing real-estate listing photos — interior and exterior shots of properties being marketed for sale or lease. You may not use the Service to edit any other type of photo (including but not limited to: personal portraits, family photos, social-media content, art, products, events, headshots, or any image unrelated to a real-estate listing).

We may suspend or terminate accounts that violate these rules. The Service may automatically reject or flag images that are not real-estate photos.

No reverse-engineering, no copying the concept

PropShot — including its tools, workflow, user interface, design choices, prompts, models, server-side pipeline, the order in which steps are presented, the pricing structure, and the way features are combined — is the result of substantial work and is treated as the confidential proprietary information of PropShot. By creating an account or using PropShot in any capacity — including as a paying user, free-trial user, beta tester, demo participant, evaluator, contractor, or invited guest — you agree that you will not, directly or indirectly, alone or with others:

These obligations are in effect for as long as you use the Service and for 24 months after you stop using it. They survive account termination and deletion. Each rule above is a separate promise; if any one is held unenforceable in a jurisdiction, the others continue to apply.

Pre-release / tester confidentiality. If we share access to anything that is not yet publicly launched — private invites, demos, internal screens, draft pricing, beta builds, unreleased features, design files, or anything marked or described as confidential — it is confidential. You agree not to screenshot, record, publish, post, share, summarize, describe, or disclose it to any third party without our prior written permission. Treat it as you would your own trade secrets.

Remedies. You acknowledge that money damages alone would not adequately compensate PropShot for a breach of this section and that PropShot is entitled to seek injunctive and equitable relief, in addition to any other remedies, without the requirement of posting a bond.

Nothing in this section limits rights you have under applicable law (for example, permitted reverse-engineering for interoperability under Section 117 of the U.S. Copyright Act, or non-waivable consumer or whistle-blower protections in your jurisdiction). Independent product ideas you developed before using PropShot, and which you can demonstrably document, are not restricted — but ideas, refinements, or executions developed during or after your use of PropShot that draw on what you saw here are covered.

Your photos are yours

Disclosure responsibilities — IMPORTANT

PropShot edits and stages photos using software, including generative-AI tools. You — the licensed real-estate agent — are solely responsible for following all listing-disclosure rules in your jurisdiction regarding edited, enhanced, virtually-staged, or otherwise modified photos. This includes (but is not limited to) National Association of Realtors Code of Ethics Article 12 / Standard of Practice 12-5, MLS rules, California AB 723, the Colorado AI Act, and any other state, local, or board-level disclosure requirements.

PropShot provides optional compliance aids — a "digitally enhanced" disclosure badge, a copy-paste disclosure snippet, and a link to view the unedited original. These are tools to help you comply, not enforcement. PropShot is a tool, not a compliance enforcer or legal advisor.

Payments

Current prices, per-photo overage, and the Twilight surcharge are listed on the Pricing page.

Refunds

Refund requests must be made within 7 days of purchase. After 7 days, no refunds will be issued. To request a refund within the window, use our contact form and choose "Refund request" as the topic.

Free preview limits

New accounts get up to 4 free preview generations to evaluate the tools before paying. Your free previews reset to 4 after any pack purchase. We also enforce a site-wide daily preview budget; when reached, free previews are temporarily paused until the next day or until additional purchases occur. Failed or partial generations are not counted. We may adjust these numbers to prevent abuse.

No warranty

The Service is provided "as is" without warranties of any kind. Edits are AI-assisted and may contain errors. Review every photo before publishing it to a listing.

Limitation of liability

To the maximum extent permitted by law, PropShot's total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages.

Account termination

You can delete your account at any time. We may suspend or terminate your account for material breach of these Terms.

Changes to these Terms

We may update these Terms. Material changes will be posted here with an updated date. Continued use after a change constitutes acceptance.

Governing law

These Terms are governed by the laws of the State where PropShot is incorporated, without regard to conflict-of-law principles. Disputes are resolved in those courts.
